  1. GENERAL CONDITIONS

Except where otherwise specified, we, TLC Worldwide Travel Limited, a company registered in England with company number 13047019 and registered office address of Watson House 1st Floor, 54 Baker Street, London, United Kingdom, W1U 7BU trading as ‘Travel Credits’, act only as an agent in respect of all bookings we take and/or make on your behalf.

(The “Agency”) is the owner of this website, and these Terms and Conditions, together with the Privacy Policy and Cookies Policy, are the legal framework that governs the use of the website www.travelcredits.com. TLC Worldwide Travel reserves the right to amend all or any part of these Terms and Conditions at any time.

We accept no liability in relation to any contract you enter into or for any travel arrangements or other services you purchase (“Arrangements”) or for the acts or omissions of any supplier or other person(s) or party(ies) connected with any arrangements. For all Arrangements, your contract will be with the supplier of the arrangements in question (referred to as “Supplier/Principal”) as appears on your booking confirmation email.

By making a booking with us, the first named person on the booking agrees on behalf of all persons detailed on the booking that he/she:

  1. read these Agency Terms & Conditions and agree to be bound by them;
  2. consents to our use of personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements); and
  3. is over 18 years of age and resident in the United Kingdom and where placing an order for services with age restrictions you declare that you and all members of your party are of the appropriate age to purchase those services;
  4. accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.

1. Our Role

When making your booking we will arrange for you to enter into a contract with the applicable Supplier/Principal (e.g. tour operator/airline/cruise company/accommodation company) of the Arrangements, as specified on your confirmation invoice. As agent we accept no responsibility for the acts or omissions of the Supplier/Principal or for the services provided by them. Your booking with us is subject to these Agency Terms and Conditions and the specific terms and conditions of the relevant Supplier/Principal(s) you contract with and you are advised to read both carefully prior to booking. The Supplier/Principal’s booking conditions may limit and/or exclude the Supplier/Principal's liability to you. Please ask us for copies of these if you do not have them.

Your booking is confirmed and a contract between you and the Supplier/Principal will exist when we send you confirmation on their behalf.

2. Booking site - conditions of use

‘Travel Credits’ is an online booking platform where users can redeem a Travel Credit by entering a unique booking code – hereinafter the “promotional code” and pin number distributed after valid participation in one of the promotional campaigns organised by the Agency (hereinafter the "Promotional Campaign”). The promotional code, combined with a supplied pin code is exchangeable for credit usable against a booking at a chosen participating venue when booked via www.travelcredits.com

Access to this website is not permitted to persons under the age of 18.

The use of this online platform by any user deems automatic acceptance of these General Conditions of Use. 

Bookings can only be made via this website via completion of the online booking form. Any booking made directly with the hotel will not be honoured nor reimbursed by TLC.

The list of participating hotels featured on this website remains subject to change, promotional availability and possible modifications.

The user is solely responsible for providing his or her personal data correctly in the process of registering and exchanging the promotional code. The Agency reserves the right to exclude any user from the services offered on this website who has provided false personal data or who attempts to make fraudulent use of the platform, without any compensation, prejudice to other actions that may be appropriate in law. Likewise, temporary and/or anonymous e-mail addresses will be considered invalid.

The Agency is not responsible if the user has not received the booking confirmation email because the personal data provided was incorrect.

The Agency will treat the personal data of the users in accordance with the Privacy Policy.

The user agrees not to introduce or disseminate on this website data programs that cause damage to the computer systems of this website, of the access provider, of its suppliers or of third-party users of the Internet network, as well as not to carry out illegal or criminal activities or that infringe any regulation of the applicable legal system.

The user may not reproduce, duplicate, or sell any content of this website, nor impersonate other users by using their promotional codes to enjoy the various services and/or content offered by this website. The Agency reserve the right to require members to provide further verification of their entitlement to participate. 

If the user violates or breaches any of the rules outlined here or any other regulation of the applicable legal system that causes damages to the Agency, the user will be responsible for any claim, fine or sanction that may be imposed on the Agency.

3 . Promotional code - conditions of use 

The Promotional Code will have a period of validity that will be defined in the Terms and Conditions of the Promotional Campaign.

The Promotional Code will allow access to the platform as many times as necessary, during its period of validity. No extension request will be accepted by the Agency.

4. Booking

The booking process will be as follows:

  • A monetary value will be shown in the user’s account appropriate for the promotional campaign and all or part will be applied to the total value of the hotel stay selected.
  • In the event that part of the balance can be applied to the total value of the hotel stay, the user will be required to pay the remaining balance.
  • Once the user has selected the hotel of their choice, they must confirm their details and will automatically receive an email booking confirmation with relevant details of the venue they have booked.

When a booking is made all details will be displayed on the booking webpage of our website. Once you have confirmed these details we will proceed to confirm the booking with the Supplier/Principal named in your booking confirmation email.

Please check that all names, dates and timings are correct on receipt of all documents and advise us of any errors immediately. In the instance of international travel, please ensure that the names given are the same as in the relevant passport. The booking information that you provide to us will be passed on only to the relevant Supplier/Principal of your Arrangements or other persons necessary for the provision of your Arrangements. The information may be provided to public authorities such as customs or immigration if required by them, or as required by law. This applies to any special category (sensitive) information that you give to us such as details of any disabilities, or dietary and religious requirements. In making this booking, you consent to this information being passed on to the relevant persons. Certain information may also be passed on to security or credit checking companies. If you are travelling to the United States, the US Customs and Border Protection will receive this information for the purposes of preventing and combating terrorism and other transnational serious crimes. If you travel outside the European Economic Area, controls on data protection may not be as strong as the legal requirements in this country. If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we will be unable to provide your booking. Full details of our data protection policy are available upon request.

5. Payment

In order to book your chosen Arrangements, you must in full as required by the Supplier/Principal of the Arrangements. Payment can be made through a combination of the monetary value on Travel Credits account and using an accepted payment card.

Except where otherwise advised or stated in the booking conditions of the Supplier/Principal concerned, all monies you pay to us for Arrangements will be held on behalf of the Supplier/Principal and forwarded on to the Supplier/Principal in accordance with our agreement with the Supplier/Principal.

6. Prices

We reserve the right to amend advertised prices at any time.  We also reserve the right to correct errors in both advertised and confirmed prices. Special note: changes and errors sometimes occur.  You must check the price of your chosen Arrangements at the time of booking.

In some instances, you may incur additional payment charges from your bank or currency conversion charges from our base currency, GBP, to your local currency.

7. Hotel loyalty programs

If you are a hotel loyalty program member, when booking hotels through the Travel Credits platform, please note that your hotel loyalty program benefits may not apply. It is your responsibility to check with the hotel first if you will receive benefits when booking through a wholesaler and not direct with the hotel. TLC Worldwide Travel Ltd is not able to assist in adding loyalty program benefits should your online booking not be eligible.

8. Insurance

Many Supplier/Principals require you to take out travel insurance as a condition of booking with them. In any event, we strongly advise that you take out a policy of insurance in order to cover you and your party against the cost of cancellation by you; the cost of assistance (including repatriation) in the event of accident or illness; loss of baggage and money; and other expenses.

9. Special requests

If you have any special requests (for example dietary requirements, cots or room location), please let us know at the time of booking by emailing customerservice_bk@travelcredits.com. We will pass on all such requests to the Supplier/Principal, but we cannot guarantee that they will be met and we will have no liability to you if they are not.

10. Changes and Cancellations by you

Any cancellation or amendment request must be sent to us in writing, by email to customerservice_bk@travelcredits.com and will take effect at the time we receive it. Please note that all our customer service team operates 09.00-1600 weekdays only, so requests much be received no later than an hour before close of business. Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that the Supplier/Principal will meet such requests. Amendments and cancellations can only be accepted in accordance with the terms and conditions of the Supplier/Principal of your Arrangements. The Supplier/Principal may charge the cancellation or amendment charges shown in their booking conditions (which may be as much as 100% of the cost of the Arrangements and will normally increase closer to the date of departure).

Please note: some Supplier/Principals do not allow changes and therefore full cancellation charges will apply. Additionally, in circumstances where refunds are processed, these are affected by daily FX rates and local bank charges.

If users should choose not to travel and do not make arrangements to change or cancel the booking, this will be classified as a ‘no show’, users will lose their right to their hotel stay and will not be able to rebook another stay and will lose access to the Travel Credits booking platform. They will have no right for any substitute offer, no compensation of any kind or cash equivalent.

11. Changes and Cancellations by the Supplier/Principal

We will inform you as soon as reasonably possible if the Supplier/Principal needs to make a significant change to your confirmed Arrangements or to cancel them. We will also liaise between you and the Supplier/Principal in relation to any alternative arrangements offered by the supplier but we will have no further liability to you.

12. Our responsibility for your booking

Your contract is with the Supplier/Principal and its booking conditions apply. As agent, we accept no responsibility for the actual provision of the Arrangements. Our responsibilities are limited to making the booking in accordance with your instructions. We accept no responsibility for any information about the Arrangements that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of the commission we earn on your booking (or the appropriate proportion of this if not everyone on the booking is affected). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment.

13. Visa, passport and health requirements

Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. Neither we nor the Supplier/Principal accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Please note that these requirements may change between booking and departure. Most countries now require passports to be valid for at least 6 months after your return date. You should check with your doctor for your specific circumstances in relation to any health formalities required for your trip.

You should enquire about local issues and conditions at overseas destinations prior to travel. TLC Worldwide Travel Ltd makes no representations as to the safety, conditions or other issues that may exist at any destination. Travel advice can be obtained from various sources, including local governments, local consular offices and the website of your country’s Foreign Office.

14. Complaints

If you wish to complain about any service we have provided to you (i.e. our booking service) then please contact us directly at customerservice_bk@travelcredits.com.

Because the contract for your hotel stay is between you and the Supplier/Principal, any queries or concerns about your Arrangements should be addressed to them. If you have an issue with your Arrangements whilst using them, this must be reported to the Supplier/Principal immediately. If you fail to follow this procedure there will be less opportunity for the Supplier/Principal to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.

If you wish to complain when you return home, write to the Supplier/Principal. You will see their name and contact details in any confirmation documents we send you.

15. Delivery of documents

All documents (e.g. booking confirmations / invoices) will be sent to you by email. You must ensure that you provide your correct email address as the time of booking. If tickets or other documents need to be reissued please email our customer service team on customerservice_bk@travelcredits.com quoting your username and the name of the campaign. Please check your email regularly to ensure prompt receipt of any relevant communications. The fares shown on this website can be purchased only in conjunction with the website. TLC Worldwide Travel Ltd does not accept any responsibility for any loss incurred as a result of any failure of email delivery (irrespective of the reason for such failure)

16. Accommodation Ratings and Standards

All ratings are as provided by the relevant Supplier/Principal. These are intended to give a guide to the services and facilities you should expect from your accommodation. Standards and ratings may vary between countries, as well as between suppliers. We cannot guarantee the accuracy of any ratings given.

17. Documentation & Information 

All descriptions and content on our website or otherwise issued by us is done so on behalf of the Supplier/Principal in question are intended to present a general idea of the services provided by the Supplier/Principal. Not all details of the relevant services can be included on our website. All services shown are subject to availability. If you require any further details, in respect of any Arrangements or any other services please contact us.

It is expressly agreed that the data stored in the information systems of the Travel Credits website, or its partners shall constitute proof with respect to the bookings made by the user. Data stored in computers or electronic media are valid proof and shall therefore be acceptable under the same conditions and with the same evidential value as a physical written document.

18. Responsibility

All information sent to the user will be considered as the responsibility of ownership by the user. The Agency accepts no responsibility for loss, theft or damage of information that makes it unusable or illegible will not entitle the user to a replacement.

Insofar as permitted by law, neither TLC, its agents or distributors will in any circumstances be responsible or liable to compensate the purchaser or other bearer or accept any liability any personal loss or injury occurring at the hotel, neither can they guarantee the quality and/or availability of the services offered by the hotels and cannot be held liable for any resulting personal loss or damage. Your statutory rights are unaffected.

19. Intellectual and industrial property

All the contents of this website, such as texts, photographs, graphics, images, icons, technology, software, links and other audio-visual or sound contents, as well as its graphic design and source codes, are the intellectual property of the Agency or of authorized third parties, none of these rights can be transferred to the user.

20. Law and Jurisdiction

These Agency Terms & Conditions are governed by English law and we both agree that the courts of England and Wales have exclusive jurisdiction (unless you live in Scotland or Northern Ireland, in which case you can bring proceedings in your local court under Scottish or Northern Irish law, as applicable).
